Terms of Service

These Terms of Service ("Terms") govern your use of the mobile apps (iOS and Android), web apps, and websites operated by Aberkane Software House FZ LLC ("Aberkane Software House", "we", "us", or "our") — together, the "Services".

Please read these Terms carefully. By downloading, accessing, or using any of our Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services. An individual Service may also have its own additional terms; where they conflict with these Terms for that Service, the additional terms control for that Service.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the Services. If you are under the age of majority where you live, you may use the Services only with the involvement and consent of a parent or legal guardian who agrees to these Terms. By using the Services, you represent that you meet these requirements and that you are not barred from using them under any applicable law.

2. License to use the Services

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to download and use our apps on devices you own or control, and to access our web apps and websites, for your personal or internal business use. For apps obtained through an app store, this license is also subject to the applicable store's Usage Rules.

You may not, except to the extent permitted by law: copy, modify, or create derivative works of the Services; reverse engineer, decompile, or disassemble any part of them; rent, lease, lend, sell, or sublicense them; remove any proprietary notices; or use them in any way not expressly permitted by these Terms.

3. Your account

Some Services require you to create an account. You agree to provide accurate information, to keep it up to date, and to keep your credentials confidential. You are responsible for all activity that occurs under your account. Notify us promptly at hello@aberkane.io if you suspect any unauthorized use. You may delete your account at any time as described in our Privacy Policy.

4. Subscriptions and purchases

Some Services offer paid features, subscriptions, or in-app purchases.

• Billing. Purchases made in our iOS and Android apps are processed by Apple or Google through your app-store account. Purchases made on the web may be processed by our payment processor. Prices are shown before you buy and may vary by region and applicable taxes.
• Auto-renewal. Subscriptions automatically renew for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• Managing and canceling. You can manage or cancel a subscription in your Apple App Store or Google Play account settings, or — for web subscriptions — through the account or billing settings we provide. Canceling stops future renewals; it does not retroactively refund the current period.
• Free trials. If a free trial is offered, it converts to a paid subscription unless you cancel before the trial ends. Any unused portion of a trial is forfeited when you purchase a subscription.
• Refunds. Refunds for purchases made through the Apple App Store or Google Play are handled by Apple or Google under their policies; we generally cannot grant them directly. For web purchases, our refund policy or applicable law governs. Nothing in these Terms limits any statutory refund or cancellation rights you may have.
• Price changes. We may change prices or the features included in a plan. Where required, we will give you advance notice and, for recurring subscriptions, the opportunity to cancel before a change takes effect.

5. Acceptable use

You agree not to, and not to allow anyone else to:

• Use the Services for any unlawful, fraudulent, or harmful purpose, or in violation of these Terms;
• Infringe the intellectual property, privacy, or other rights of others;
• Upload or transmit malware, or otherwise interfere with, disrupt, or overburden the Services or their infrastructure;
• Attempt to gain unauthorized access to any account, system, or data, or bypass any security or access controls;
• Scrape, harvest, or collect data from the Services except as expressly permitted; or
• Use the Services to build a competing product, or to send unsolicited or unauthorized messages.

6. Your content

Some Services let you create, upload, or store content. You retain ownership of the content you provide. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and process that content solely as needed to operate and provide the Services to you. You are responsible for your content and for having the rights necessary to share it, and you agree it will not violate these Terms or any law. We may remove content that we reasonably believe violates these Terms or applicable law.

7. Intellectual property

The Services, including their software, design, text, graphics, logos, and other content (other than your content), are owned by Aberkane Software House FZ LLC or our licensors and are protected by intellectual-property laws. Except for the limited license granted to you in these Terms, we reserve all rights. "Aberkane Software House" and our product names and logos are our trademarks; you may not use them without our prior written permission.

8. Third-party services

The Services may interoperate with or link to third-party products, websites, and services that we do not control. We provide them for convenience and are not responsible for them; your use of a third party is governed by that third party's terms and policies.

9. Privacy

Our Privacy Policy explains how we collect, use, and protect your information, and forms part of these Terms. By using the Services, you consent to the practices described there.

10. Disclaimers

To the fullest extent permitted by law, the Services are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free, or that any content or results will be accurate or reliable. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

11. Limitation of liability

To the fullest extent permitted by law, Aberkane Software House and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of, or inability to use, the Services. To the fullest extent permitted by law, our total liability for all claims relating to the Services will not exceed the greater of the amount you paid us for the relevant Service in the twelve months before the claim, or fifty United States dollars (US$50). Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

12. Indemnification

You agree to indemnify and hold harmless Aberkane Software House and its officers, employees, and suppliers from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Services, your violation of these Terms, or your violation of any law or the rights of a third party, to the extent permitted by applicable law.

13. Termination

You may stop using the Services and delete your account at any time. We may suspend or terminate your access to the Services, in whole or in part, if you breach these Terms, if we are required to by law, or if we discontinue a Service. Upon termination, the license granted to you ends and you must stop using the affected Service. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.

14. Changes to the Services and these Terms

We may modify, suspend, or discontinue any part of the Services at any time. We may also update these Terms from time to time; when we do, we will revise the "Last updated" date above and, for material changes, provide additional notice where appropriate. Your continued use of the Services after an update means you accept the revised Terms.

15. Governing law and disputes

These Terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-laws principles. Subject to any mandatory rights you have under the laws of your country of residence, you agree that the courts of Dubai, United Arab Emirates will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services.

16. Additional terms for apps obtained from the Apple App Store

If you obtain one of our apps through the Apple App Store, the following additional terms apply, and in the event of a conflict with the rest of these Terms with respect to that app, these additional terms control:

• These Terms are between you and Aberkane Software House only, and not with Apple. Apple is not responsible for the app or its content.
• The license granted to you is limited to a non-transferable license to use the app on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• Apple has no obligation to provide any maintenance or support services for the app.
• In the event the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) you paid for the app. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• Apple is not responsible for addressing any claims by you or a third party relating to the app, including product-liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims under consumer-protection or similar legislation.
• Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the app or your use of it infringes that third party's intellectual-property rights.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as a third-party beneficiary.

17. Additional terms for apps obtained from Google Play

If you obtain one of our apps through Google Play, your use of the app is also subject to the Google Play Terms of Service and the Google Play Business and Program Policies. These Terms are between you and Aberkane Software House only, and not with Google. Google is not responsible for the app or its content and is not a party to these Terms, except that Google Play's terms govern the download and payment for the app.

18. General

These Terms, together with our Privacy Policy and any Service-specific terms, are the entire agreement between you and us regarding the Services. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for any delay or failure to perform caused by events beyond our reasonable control.
